Your contractor walks the attic, taps the collar ties, and says the space is straightforward — insulate, drywall, add a dormer, done. Then the plans go in and the reviewer's comment has nothing to do with insulation. It says the attic will be counted as a story, and the whole project changes shape.
The short answer: California treats a habitable attic as a story above grade plane by default. It is only exempt from that count where all four of the code's conditions are met — chief among them, the attic's aggregate area staying at or under one-third of the floor area of the story below, or one-half where the dwelling unit has an automatic sprinkler system (§ R316.3).
Story count is one of those quiet classifications that decides a lot of other things at once — height limits, construction requirements, and in some cases sprinklers. It is worth settling before the design work starts, not after.

The default is that it counts
The rule opens flatly:
A habitable attic shall be considered a story above grade plane.
— § R316.3
That is the starting position, and the exceptions are what you have to earn. "Habitable attic" is the code's term for attic space finished for living in, as opposed to an attic you crawl into twice a year. Once the space is habitable, the question is no longer whether it is an attic — it is whether it counts as a floor of the house.
There are four conditions, and the exception applies only if the attic meets all of them:
- Size. The aggregate area is no greater than one-third of the floor area of the story below — or no greater than one-half where the habitable attic is inside a dwelling unit equipped with an automatic sprinkler system installed per the code's referenced sprinkler section.
- Enclosure. The occupiable space is enclosed by the roof assembly above, by knee walls on the sides where applicable, and by the floor-ceiling assembly below.
- Footprint. The floor of the habitable attic does not extend beyond the exterior walls of the story below.
- Height in the stack. Where a habitable attic sits above a third story, an automatic sprinkler system must be installed in the attic and in the remaining portion of the townhouse unit or dwelling unit or units beneath it.
Condition three is the one that catches people mid-design. A dormer that cantilevers, or an attic floor pushed out over a bay below, breaks the exception — and the space becomes a story regardless of how modest it is.
Condition one is where the sprinkler trade lives. Going from one-third to one-half of the floor below is a meaningful gain on a large plan, and it is a decision better made while the layout is still fluid.
Getting into the attic
Access is a separate requirement from habitability, and it applies well before anyone finishes the space.
In a house, an access opening is required to any attic having a vertical height of 30 inches or greater over an area of at least 30 square feet, measured from the top of the ceiling framing members to the underside of the roof framing members. The rough-framed opening must be not less than 22 inches by 30 inches, and it must be located in a hallway or another location with ready access (§ R807.1).
Orientation matters. In a wall, the opening is at least 22 inches wide by 30 inches high. In a ceiling, there must be at least 30 inches of unobstructed headroom in the attic above the access, measured along one side or more from the bottom of the ceiling framing members. And where mechanical equipment sits in the attic, the mechanical code adds its own access requirements on top.
Other building types follow a parallel rule: an opening of not less than 20 inches by 30 inches to any attic with a clear height over 30 inches, with at least 30 inches of clear headroom at or above the opening (§ 1209.2).
What these sections deliberately do not tell you
This is the honest limit of what the habitable attic provisions cover, and it matters more than usual here.
The code says a habitable attic must have a floor area and a ceiling height set by other sections, and that its means of egress must comply with the applicable provisions of a separate egress section (§ R316.2 and § R316.4). The habitable attic section itself contains none of those numbers.
So the three questions people most often arrive with — how tall does the ceiling have to be, how much floor area do I need, and does the stair or window count as a way out — are answered elsewhere, and they should be looked up rather than assumed. In a sloped attic, the ceiling height question is usually not "how tall is it at the ridge" but "how much of the floor area meets the required height," which is exactly the kind of detail a remembered number gets wrong.
These sections also say nothing about insulation, energy compliance, structural capacity of the existing ceiling joists to serve as floor joists, or smoke and carbon monoxide alarms — all of which a real attic conversion has to satisfy.
State floor, local control
Everything above is state code, applying across California as a minimum. Cities and counties can adopt stricter local amendments, and zoning is a separate matter entirely: a local height limit or a story limit in your zoning district can restrict an attic conversion even where the building code would allow it. In hillside and historic districts, that local layer is often the binding one.
Because story count is the hinge, take that question to your building department first with a sketch showing the attic area against the floor below. It is a short conversation that reshapes the entire project, and it is far cheaper before the drawings than after.
