Article 19 — PROCEDURES FOR FLOODPLAIN MANAGEMENT

Editor's note—Ord. No. 78-48, § 1, adopted Oct. 18, 1978, specifically amended the Code by adding Art. 19, §§ 6-470—6-474. Art. 19 as set out in Ord. 78-48, Ord. 80-90 and Ord. 93-1 was entirely replaced by Ord. 2009-27, adopted December 16, 2009.

§ 6-470.3. Methods of reducing flood losses.

In order to accomplish its purposes, this article includes regulations to:

  • (a) Restrict or prohibit uses which are dangerous to health, safety, and property due to water or erosion hazards, or which result in damaging increases in erosion or flood heights or velocities;

  • (b) Require that uses vulnerable to floods, including facilities which serve such uses, be protected against flood damage at the time of initial construction;

  • (c) Control the alteration of natural floodplains, stream channels, and natural protective barriers, which help accommodate or channel floodwaters;

  • (d) Control filling, grading, dredging, and other development which may increase flood damage; and

  • (e) Prevent or regulate the construction of flood barriers which will unnaturally divert flood waters or which may increase flood hazards in other areas.

§ 6-473.3. Appeals.

The city council of the City of Escondido shall hear and decide appeals when it is alleged there is an error in any requirement, decision, or determination made by the floodplain administrator in the enforcement or administration of this article.
