Chapter 35 — PUBLIC SAFETY AND PROTECTION

It is the purpose of this subchapter to recover the administrative costs incurred when an individual is arrested and booked at the City Police Station. These individuals have violated the law or committee a negligent act, and it is not the responsibility of the community as a whole to bare the administrative costs of booking such individuals. Such costs should be the responsibility of the person who committed the criminal offense that led to their booking. (Prior Code, § 3761) (Ord. 96-4, passed 9-3-1996)

(A) Upon the conviction of any criminal offense related to the arrest, the Police Department shall make every reasonable effort to recover administrative fees incurred in the booking process at its booking facility for the following:

• (1) Transportation;

• (2) Searching;

• (3) Clothing;

• (4) Fingerprinting;

• (5) Photographing;

• (6) Inventorying and storage of arrestee’s property;

• (7) Documentation preparation;

• (8) Retrieval;

• (9) Updating files;

• (10) Court scheduling; and

• (11) Warrant service and processing.

• (B) The booking fee shall be set by resolution of the City Council and may be adjusted periodically to remain consistent with County Jail booking fees.

(C) If the individual is a subscriber on a city water bill, or lives at a location in the city with his or her parents or spouse, the booking fee may be added to that person’s water bill. Costs incurred by the Finance Department may also be added to the amount owed. Finance Department costs will be set by resolution.

(D) If the delinquent account is taken to small claims court, preparation and court time shall be charged at the employee’s hourly rate plus benefits.

FIRE HAZARD SEVERITY ZONES

(A) The City Council hereby designates the fire hazard severity zones as recommended by the California Department of Forestry and Fire Protection pursuant to Cal. Government Code § 51178.

(B) The map, approved by the city, is hereby incorporated by reference, and entitled "City of Grover Beach Fire Hazard Severity Zones."
