Chapter 9.44 — R1 SINGLE-FAMILY RESIDENCE DISTRICT

§ 9.44.010. Purpose of district. ¶
The R-1 district is established to provide for the development and maintenance of medium density single-family detached residential neighborhoods. Only those uses are permitted that are complementary to and can exist in harmony with such a residential neighborhood. (Ord. 176 § 1, 2007)
§ 9.44.020. Principal uses permitted. ¶
The following principal uses are permitted:
A. Single-family detached dwellings;
B. Parks, playgrounds, and athletic fields (noncommercial);
C. Residential care facilities, in accordance with Chapter 5.44 (Residential Care Facilities);
D. Small and large family day care homes;
E. Limited home rentals.

§ 9.44.030. Principal uses permitted subject to a site development permit. ¶
The following principal uses are permitted subject to the approval of a site development permit under Section 9.184.010 :
A. Public libraries and museums;
B. Public or private utility buildings or structures.

§ 9.44.040. Principal uses permitted subject to a use permit. ¶
The following principal uses are permitted subject to the approval of a use permit by the Planning Commission under Section 9.184.010 :
A. Wireless communication facilities under Chapter 9.162 of this Code;
B. Churches, temples, and other places of worship;
C. Educational institutions;
D. Any other use that the Planning Commission finds is consistent with the purpose and intent of this district.

§ 9.44.050. Temporary uses permitted. ¶
Certain temporary uses, permitted per Section 9.144.070 , include the following:
A. Christmas tree sales;
B. Continued use of an existing building during construction of a new building;
C. Halloween pumpkin sales;
D. Mobilehome residence during construction of a dwelling;
E. Residential tract sales and rentals.

§ 9.44.060. Accessory uses and structures permitted. ¶
The following accessory uses and structures are permitted when associated with and subordinate to a permitted principal use on the same legal parcel of land:
A. Uses permitted under Section 9.144.080 ;
B. Signs, as permitted by Chapter 9.164 ;
C. Noncommercial keeping of pets and animals in accordance with Section 9.146.030 ;
D. Home occupations under Section 9.146.060 ;
E. Riding and hiking trails;
F. Accessory dwelling units under Section 9.146.050 ;
G. Accessory uses and structures that the Director of Community Development finds are consistent with the purpose and intent of this district.

§ 9.44.070. Prohibited uses. ¶
Notwithstanding Sections 9.44.020 through 9.44.060 , the following uses are specifically prohibited:
A. Apiaries;
B. Keeping pets or animals for any commercial purpose unless otherwise provided for by an approved use permit;
C. The storage of vehicles, equipment, or products related to a commercial activity not permitted in this district;
D. Transitory lodgings;
E. Uses not expressly permitted by this chapter.

§ 9.44.080. Site development standards. ¶
A. Building Site Area. Seven thousand two hundred square feet minimum except per Section 9.144.020 .
B. Building Height. Thirty-five feet maximum except per Section 9.144.020 .
C. Building Setbacks. Per Sections 9.144.030 , 9.144.040 , and 9.144.080 .
D. Off-Street Parking. Per Section 9.168.010 .
E. Lights. All lights shall be designed and located so that direct light rays shall be confined to the premises.

§ 9.44.090. Ancillary uses permitted. ¶
The following ancillary uses are permitted subject to special provisions as noted:
- A. Power supply facility in accordance with Chapter 9.166 of this Code. (Ord. 176 § 1, 2007)
