§ 9-4.101. Purpose.

The Council hereby declares that this article is adopted in order to conform with the provisions of the Environmental Quality Act of 1970 of the State.

§ 9-4.102. Costs: Liability.

The costs for the preparation of any environmental study and environmental impact report required to be prepared by the City pursuant to the provisions of the Environmental Quality Act of 1970 of the

State shall be paid by the applicant seeking the particular zone change, building permit, or other entitlement involved.

§ 9-4.103. Costs: Estimates: Payments.

  • (a) The appropriate City agency which is to undertake the preparation of the study and the report, prior to the undertaking by such agency of such a study, shall formulate an estimate of the costs to the City of such a study and report, including the costs of the time of the agency employees, travel and equipment costs, and the fees and expenses of persons not in City employ, whose services are required.

  • (b) Upon the completion of such an estimate of costs, the appropriate City agency shall notify the applicant for such permit, zone change, or other entitlement of such estimate and shall not thereafter proceed with such study until said sum has been paid to the City by the applicant.
