Sec. 32D.1. - Authority.¶
This chapter and the adoption of the parks impact fee are enacted pursuant to California Government Code section 66000, et seq. (Mitigation Fee Act).
(Ord. No. 25-OR0671-1, § 2, 12-3-2025)
Sec. 32D.2. - Purpose.¶
The purpose of the parks impact fee is to ensure that future residential development in the City of Oceanside contributes a reasonable and fair share to fund the construction and acquisition of public facilities and infrastructure improvements required to provide public park and recreation facilities for new residential development. The parks impact fee also ensures that existing residents and developments will not bear a disproportionate share of the cost for such improvements. The fees collected shall be used to fund projects identified in the city's capital improvement program and related public infrastructure plans.
(Ord. No. 25-OR0671-1, § 2, 12-3-2025)

Sec. 32D.4. - Parks impact fee established.¶
(a) A parks impact fee is hereby established as a condition of the issuance of any permit for any residential development, unless expressly exempted by this chapter or state law. Establishment of the parks impact fee does not replace or supersede other development fees, charges, or requirements that are authorized in the City Code.
(b) The parks impact fee shall not apply to accessory dwelling units less than seven hundred fifty (750) square feet in size in accordance with Government Code section 66324(c); government buildings; or structures owned by a public agency.

In accordance with chapter 32B of the City Code, the parks impact fee authorized in this chapter and adopted by resolution shall be automatically updated by the city manager or designee at the beginning of each fiscal year on July 1, without further city council action necessary, by an amount that is the greater of two (2) percent or the percentage change in the Construction Cost Index (CCI) as most recently published by the Engineering News Record (20-Cities Average) for a twelve-month period, or a similar published index if the CCI is no longer available.
(d) Fees collected pursuant to this chapter shall be allocated and expended pursuant to the requirements of chapter 32B of the City Code.
