Chapter 115 — PUBLIC DANCES

§ 115.01 DEFINITION.

For the purpose of this chapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.

PUBLIC DANCE. Any dance to which the public generally may gain admittance with or without the payment of a fee.

§ 115.02 PERMIT REQUIRED.

It shall be unlawful for any person to open, conduct or carry on, or to participate in the opening, conducting or carrying on, of a public dance or public dance hall in the city unless there exists a valid permit. (`67 Code, § 7-9-2)

§ 115.03 ISSUANCE OF PERMIT.

Upon receipt of an application for a permit by the Clerk, a permit shall be issued if the applicant is in good standing. A permit shall be required for each dance, provided, however, that upon proper application and payment of the required fees and costs, the Clerk may issue a permit to cover all dances to be held by the applicant within a period of one year. The first yearly permit issued to any applicant may be reviewed within six months from the date of its issuance, at which time a public hearing shall be held after proper notice and the Council may, at the conclusion of the hearing, revoke the permit if they find that the conducting or carrying on of the public dances has been detrimental to the general health, safety and welfare of the citizens of the city. Each application must be made not less than five days prior to the date fixed for the dance.

§ 115.04 LICENSE REQUIRED.

In addition to the permit fees and costs required under the terms of this chapter, each applicant shall obtain and maintain a license pursuant to the provisions of Chapter 110 of this Code. (`67 Code, § 7-9-5)

§ 115.05 WAIVER OF FEES.

The Council, upon proper application, may waive any and all permit fees and license fees for dances held by bona fide memorial, fraternal, charitable, or nonprofit organizations and associations which shall otherwise be subject to all the provisions of this chapter.

§ 115.06 RULES AND REGULATIONS OF OPERATION.

It shall be unlawful to open, conduct, or carry on a public dance or to dance in a public dance hall in violation of the following rules and regulations:

(A) No public dance shall be held or conducted unless a valid, unrevoked permit therefor is in full force and effect with all fees and costs prepaid as set forth in this chapter.

(B) Every person obtaining a permit under the provisions of this chapter shall place such permit in a conspicuous place in the place or places named in such permit and shall show such permit whenever required to do so by any police officer of the city.

(C) No public dancing shall be permitted between the hours of 2:01 a.m. and 7:00 p.m. of the same day.
