Article 17 — ENFORCEMENT, VIOLATIONS AND PENALTIES

23.17.01: PLANNING AND BUILDING DIRECTOR, CITY CLERK AND CHIEF OF POLICE TO ENFORCE…

A. It shall be the duty of the planning and building director to enforce the provisions of this chapter pertaining to the erection, construction, reconstruction, moving, conversion or alteration of any building or any addition thereto.

B. It shall be the duty of the city clerk and all officials charged with the issuance of licenses to enforce the provisions of this chapter pertaining to the use of land or buildings for which any such license is required by any other ordinance of the city.

C. It shall be the duty of the chief of police and all officers charged with the enforcement of the law to enforce this chapter and all the provisions of the same. (Ord. 096-1093, 7-10-1996; amd. Ord. 0-09-1224, 1-13-2010)

23.17.02: VIOLATIONS DECLARED NUISANCE; ABATEMENT:

Any building or structure hereafter set up, erected, built, moved or maintained and any use of property hereafter commenced or continued contrary to the provisions of this chapter are hereby declared to be unlawful and a public nuisance, and the city prosecutor shall, upon order of the planning and building director, commence action or proceeding for the abatement, removal and enjoinment thereof, in the manner provided by law 1 , and shall take such other steps and shall apply to such court as may have jurisdiction to grant such relief as will abate and remove such building, structure or use and restrain and enjoin any person from setting up, erecting, building, moving or maintaining any such building or structure or using any property contrary to the provisions of this chapter. 23.17.03: REMEDIES CUMULATIVE AND NOT EXCLUSIVE:

All remedies provided for in this chapter shall be cumulative and not exclusive. (Ord. 096-1093, 7-10-1996; amd. Ord. 0-09-1224, 1-13-2010)

23.17.04: PENALTY:

Any person, whether acting as principal, agent, employee or otherwise, violating any provision of this chapter or of any variance or conditional permit granted hereunder shall be deemed guilty of a misdemeanor or infraction, as determined by the city prosecutor, and, upon conviction thereof, shall be punished as provided by subsection 01.04.03A of this code.
