Chapter 17.71 — MONITORING COST RECOVERY

§ 17.71.010. Purpose.

The purpose of this chapter is to provide for the determination, imposition and collection of administrative costs associated with the monitoring and enforcement of mitigation measures or conditions of approval imposed upon the granting of any permit or other entitlement authorized by this title.

§ 17.71.020. Authority.

The planning director, or his/her authorized designee, is authorized to determine, impose and collect all administrative costs associated with the monitoring or enforcement of mitigation measures or conditions of approval imposed upon the granting of any permit or other entitlement pursuant to the provisions of this title.

§ 17.71.030. Procedure.

  • A. All city departments which grant permits or entitlement under this title which impose or provide mitigation measures or conditions which require monitoring shall as a further condition of granting the permit or approving the entitlement specify that such monitoring shall be conducted and that the cost thereof shall be borne by the property owner or other person obtaining the permit or entitlement and shall be paid according to the provisions of this chapter.

  • B. The planning director shall, at the time of the granting of the permit or approval of the entitlement, submit to the approving agency his/her reasonable estimate of the administrative cost of monitoring the mitigation measures or conditions. Such approving agency shall as a condition of approval require the owner or the other person obtaining the permit or entitlement to deposit that amount on a one-time or annual basis.

  • C. If the deposit is required on an annual basis, it may be adjusted in subsequent years, by agreement of the planning director and the owner or by subsequent action by the authorizing agency at the request of the planning director or owner.

§ 17.71.040. Enforcement costs.

The planning director, or his/her authorized designee(s), is authorized to recover enforcement costs arising from the failure of any property owner or person in control to conform to or implement any mitigation measures or conditions of approval imposed by the city per Chapter 1.17 .
