§ 17.190.010. Desert Gateway Specific Plan map.

The area of the Desert Gateway Specific Plan is set forth on the following map, including the establishment of Planning Areas PA-1 and PA-2.

§ 17.190.020. Desert Gateway Specific Plan—Permitted Uses Table.

The following tables for permitted uses shall govern:

Notes:

  • 1 Cultivation projects with multiple uses may incorporate all uses under a common CUP application.

  • 2 All uses listed in the City’s Light Industrial (I-L) w/Cannabis Overlay Zone that are not specified in the table above for PA-2 shall be allowed in PA-2 subject to the appropriate permit type as described in Section 17.16.020 Permitted uses of the Desert Hot Springs Municipal Code (DHSMC).

  • 3 The general review authority (Planning Commission, City Council, etc.) for the subject permits above shall be determined as outlined in the DHSMC.

§ 17.190.030. Desert Gateway Specific Plan—Development standards.

The following development standards shall govern:

Notes:

  • 1 Except when attached buildings are proposed where side yard or building separation would not be required.

  • 2 For PA3, all interior lot lines would be considered side yards.

  • 3 Height measured from surrounding finished grade. Basements are allowed but do not count toward overall building height or number of stories.

  • 4 Any use not listed would be in accordance with DHS Municipal Code Section 17.48.040 .

  • 5 Including hallways, mechanical rooms, elevator shafts, stairways, storage areas, restrooms, locker rooms, packaging rooms, break rooms and similar support areas within buildings where cultivation is the primary function.

§ 17.190.040. Review and approval.

  • A. All uses within the Desert Gateway Specific Plan Planning Areas shall be subject to review and approval for conformance with this chapter.

  • B. Uses which are indicated as “P” (Permitted) shall require, for any related construction or development, review and approval by the Planning Commission, in accordance with Chapter 17.80 (Design Review).

  • C. Uses which are indicated as “C” (Conditionally Permitted) shall require review and approval by the Planning Commission in accordance with Chapter 17.76 (Conditional Use Permits).

  • D. Required findings for approval of Design Review (Section 17.80.040 ) or Conditional Use Permit (Section 17.76.050 ) shall include consideration of the design guidelines of the Desert Gateway Specific Plan.
