18.44.010 Purpose. ¶
In order to strengthen the public planning process, encourage private participation in comprehensive planning, and reduce the economic cost of development, the Legislature adopted Government Code Sections 65864 through 65869.5 authorizing a local government to enter into a development agreement with an applicant for a development project. The objective of a development agreement is to provide assurance that, upon approval of the project, the applicant may proceed with the project in accord with existing policies, rules and regulations, subject to the conditions of approval. 18.44.020 City council to establish procedures and requirements. ¶
A. The city council shall by resolution establish the procedures and the requirements for considering, adopting and reviewing a development agreement.
B. The procedures and requirements for considering, adopting and reviewing a development agreement and the content of the development agreement shall comply with Government Code Sections 65864 through 65869.5. [Ord. 07-1284 § 3 (Exh. C), 2007; Ord. 979 § 2 (Exh. A), 1990.]
