1 DENSITY BONUS AND HOUSING INCENTIVES

18.46.010 Purpose. ¶

The purpose of this chapter is to provide for density bonuses and incentives to developers who agree to construct a specified percentage of units of a housing development for lower- or very low-income households or for senior citizens. This chapter is adopted under Government Code Sections 65915 through 65918. [Ord. 07-1284 § 3 (Exh. C), 2007; Ord. 05-1257 § 4, 2005.]

18.46.020 Definitions. ¶

In this chapter, unless the context otherwise requires:

A. “Housing development” means one or more groups of projects for residential units consisting of five or more dwelling units. For purposes of calculating a density bonus, the residential units do not have to be based upon individual subdivision maps or parcels. (Government Code Section 65915(j).)

B. “Incentive” means a concession, allowance, or other motivating mechanism intended to ensure that the housing development will be produced at a reduced cost. (Government Code Section 65915(l).) [Ord. 07-

18.46.030 Density bonus and incentive. ¶

A developer of a housing development in the city may be permitted a density bonus and incentives in accordance with the provisions of state law and local inclusionary housing ordinance. The density bonus shall be permitted in geographic areas of the housing development other than the areas where the units for the lower-income households are located. 18.46.040 Implementation. ¶
