ACCEPTANCE OF DONATIONS OF PERSONAL PROPERTY

4.01.010 General authority of city manager.

  • A. The city manager is authorized to accept, on behalf of the city, any monetary gift or a gift of goods or personal property or an in-kind gift of services in an amount or with a value of one hundred thousand dollars or less.

  • B. All monetary gifts shall be placed in the gift trust fund immediately upon the city manager's acceptance.

4.01.020 City manager's authority to accept historical gifts.

  • A. The city manager is authorized to accept for and on behalf of the city:

    1. Gifts of personal property of historic significance to the city, including artifacts, documents, paintings, art objects and memorabilia; and

    2. Money or securities of any kind given to acquire, preserve and/or exhibit any real or personal property of historic interest.

  • B. The city manager shall consult with the historic landmarks commission regarding the acceptance of gifts having historical significance and shall consider the commission's advice and recommendations.

  • C. The city manager shall accept only such gifts of property, money and securities that conform with standards set forth in administrative guidelines approved by the city manager.

4.01.030 City manager's authority to dispose of historical gifts.

  • A. Subject to any limitations imposed on a gift to the city by the donor, the city manager is authorized to sell, exchange or otherwise dispose of personal property of historic significance that the city received as a gift. Any monies derived from the disposal shall be deposited into the appropriate gift trust fund.

  • B. The city manager shall consult with the historic landmarks commission, before disposing of personal property with historical significance that the city received as a gift and shall consider its advice and recommendations.

  • C. The city manager shall advise the historic landmarks commission at least semiannually of all items disposed of pursuant to this section, and shall follow the administrative guidelines approved by the city manager for the disposal of surplus objects.
