ADULT ACTIVITY REGULATIONS

14-24.010 General.

The regulations specified in this chapter shall be in addition to all other district regulations. (Ord. 506-80 C-M, eff. September 11, 1980)

14-24.020 Dance halls and the like.

No dance hall, road house, nightclub, commercial club, or any establishment where liquor is served or commercial place of amusement or recreation, or any place where entertainers are provided, whether as social companies or otherwise, shall be established in any Residential District, nor shall be established in any other district within two hundred (200') feet to the boundary of any Residential or Recreational District, unless a Special Use Permit is first secured in every case.

(c) The property, or any portion thereof, on which the proposed use would be located is not within 400 feet of any lot or parcel of property, or portion thereof, which is within a zoned district which designates single-family or multi-family residential uses as permitted uses.

14-24.040 Outdoor motion picture theaters.

It shall be unlawful to present or exhibit, or to permit the presentation or exhibition of, any motion picture which is distinguished or characterized by an emphasis on matter displaying, depicting, or describing specified sexual activities or specified anatomical areas, as defined in this title, at any outdoor motion picture theater.

14-24.030 Adult bookstores and adult motion picture theaters.

No Use Permit shall be granted for the purpose of operating or maintaining an adult bookstore or adult motion picture theater, unless, in addition to satisfying all other requirements imposed by this Code, the applicant can establish the following facts:

(a) The property, or any portion thereof, on which the proposed use would be located is not within five hundred (500') feet of any property, or portion thereof, used for an elementary school, junior high school, high school, whether public or private, public playground, church, or public library; and

(b) The property, or any portion thereof, on which the proposed use would be located is not
