Chapter 18.76 — USE PERMITS

§ 18.76.010. Criteria. ¶
The planning commission shall hear and decide applications for use permits when this title provides for such.

§ 18.76.020. Public hearing. ¶
A. Subject only to the rules regarding the placement of matters on the planning commission agenda, the matter shall be set for public hearing.
B. Notice shall be provide as per Section 18.79.030 .
C. Such hearing shall be conducted in the same manner as a hearing for a variance application. (Ord. 337 Exh. A, 1991)
§ 18.76.030. Decisions. ¶
Within thirty days of the conclusion of the hearing, the planning commission shall grant or deny the issuance of the use permit applied for. The granting of a use permit may be made subject to terms and conditions attached thereto and made a part thereof. The action of the planning commission shall be expressed in writing shall contain findings of fact as to the satisfaction of the conditions set forth in Section 18.76.010 . Failure of the planning commission to act within thirty days of the conclusion of the hearing shall be deemed to be a denial of the application on that date. The decision of the planning commission shall become final ten days from the date of rendering, unless an appeal has been made within that time. (Ord. 337 Exh. A, 1991)
§ 18.76.040. Limitations and expiration. ¶
A. Use permits, as well as variances, are privileges assigned to the land, not the individuals owning the land.
B. If the applicant or property owner files an application with the planning commission before the expiration of an unused use permit, for extension of the same, such request may be extended for up to one additional year. One extension may be granted for each unused use permit.
C. The planning commission may set time limits regarding the length of any use permits.
D. Time expired use permits shall not be regarded as nonconforming uses, and shall have no standing under Chapter 18.70 .
