Chapter 17.61 — PARK AND SCHOOL DISTRICT

17.61.010 Purpose.

The purpose of the Institutional Uses Zones chapter is to establish distinct zones for public schools, parks, fire stations, utilities, and water facilities to permit accurate land use designations and permit identification of public facilities throughout the city. This zone is in conformance with the General Plan and equal in importance to other land uses.

17.61.020 Prohibited uses.

The following use uses shall be prohibited in all Institutional Use Zones:

  • (A) Cannabis storefront retailer.

  • (B) Cannabis non-storefront retailer.

  • (C) Cannabis manufacturing.

  • (D) Cannabis distribution.

  • (E) Cannabis testing laboratory.

  • (F) Cannabis microbusiness.

  • (G) Cannabis cultivation.

  • (H) Any type of commercial cannabis activity.

17.61.030 Permitted uses for parks (P).

  • (A) Public parks and playgrounds;

  • (B) Public golf courses;

(C) Similar uses permitted by Planning Commission determination. The Planning Commission may, by resolution of record, permit any other use which it may determine to be similar to those listed above, in conformity with the intent and purpose of this section and not more obnoxious or detrimental to the public health, safety and welfare or the other uses permitted in this district. For procedure, the provisions of Chapter 17.88 shall apply.

17.61.040 Property development standards for parks (P) – Generally.

The property development standards set forth in §§ 17.61.050 through 17.61.090 shall apply to all the land in the Park District Zone.

17.61.050 Lot area for parks (P).

Minimum lot size shall be five acres. Smaller lot sizes may be permitted by conditional use permit. (`78 Code, § 17.61.040.) (Ord. 2885 § 2 (part), 2007; Ord. 2819 § 2, 2006; Ord. 2489 § 2, 2000.)

17.61.060 Building height for parks (P).

Maximum building or structure height shall be 35 feet.

17.61.070 Yards for parks (P).

Minimum building setbacks from the property line shall be as follows:

  • (A) Front setback shall be a minimum of 50 feet;

  • (B) Rear setback shall be a minimum of 50 feet;

  • (C) Side setback shall be a minimum of 30 feet.

17.61.080 Landscaping for parks (P).

Existing natural vegetation and land formation shall remain in a natural state unless modification is approved through site plan review in accordance with Chapter 17.102.

17.61.090 Access for parks (P).

Access and driveways shall not be developed for wheeled vehicles except through site plan review in accordance with Chapter 17.102.

17.61.100 Permitted uses for schools (S).

(A) Public schools administered by state accredited school districts, including elementary, junior high, high schools and colleges.

(B) Similar uses permitted by Planning Commission determination. The Planning Commission may, by resolution of record, permit any other use which it may determine to be similar to those listed above, in conformity with the intent and purpose of this section and not more obnoxious or detrimental to the public health, safety and welfare or the other uses permitted in this district. For procedure, the provisions of Chapter 17.88 shall apply.

17.61.110 Property development standards for schools (S) – Generally.

Property development standards for public schools are determined through the state accredited school districts in accordance with state law and regulations.

17.61.120 Permitted uses for fire stations (FS).

(A) City owned and operated first station by conditional use permit as established by § 17.92.030.

(B) Similar uses permitted by Planning Commission determination. The Planning Commission may, by resolution of record, permit any other use which it may determine to be similar to those listed above, in conformity with the

intent and purpose of this section and not more obnoxious or detrimental to the public health, safety and welfare, or the other uses permitted in this district. For procedure, the provisions of Chapter 17.88 shall apply.

17.61.130 Property development standards for fire stations (FS) – Generally.

The property development standards set forth in §§ 17.33.060 through 17.33.100 and 17.33.160 shall apply to all the land in the Fire Station zone.

17.61.140 Permitted uses for utilities (U).

(A) Publicly owned and operated electric or gas utility, communications tower, or waster waste treatment plant by conditional use permit as established by § 17.92.030.

(B) Similar uses permitted by Planning Commission determination. The Planning Commission may, by resolution of record, permit any other use which it may determine to be similar to those listed above, in conformity with the intent and purpose of this section and not more obnoxious or detrimental to the public health, safety and welfare, or the other uses permitted in this district. 17.61.150 Property development standards for utilities (U) – Generally.

The property development standards set forth in §§ 17.33.040 through 17.33.110 shall apply to all the land in the Utilities zone, with the exception that communication towers may exceed the stated height limit in compliance with Chapter 17.65.

17.61.160 Permitted uses for water facilities (WF).

(A) Publicly owned and operated water storage facility or other water facility by conditional use permit as established by § 17.92.030.

(B) Similar uses permitted by Planning Commission determination. The Planning Commission may, by resolution of record, permit any other use which it may determine to be similar to those listed above, in conformity with the intent and purpose of this section and not more obnoxious or detrimental to the public health, safety and welfare, or the other uses permitted in this district. 17.61.170 Property development standards for water facilities (WF) — Generally.

The property development standards for water facilities shall be determined through the conditional use permit process.
