§ 19.07.010. Permit and appeal jurisdiction established.

In conjunction with the delegation of Coastal Development Permit authority pursuant to Public Resources Code Section 30600.6, the Coastal Commission has, after public hearing, adopted a map of the coastal zone of the City of Imperial Beach that portrays the areas where the Commission retains permit authority pursuant to Public Resources Code Sections 30603(a)(1) and (a)(2), or 30600.5(d). This map, entitled "Post Local Coastal Program Certification Permit and Appeal Jurisdiction Map," was adopted by the Coastal Commission for the City of Imperial Beach and will serve as the Official Map of the Commission's appeal and permit jurisdiction. § 19.07.020. Provisions for updating map.

The California Coastal Commission, in consultation with the City, shall update these maps from time to time, where changes occur in the conditions on which the adopted maps were based, or where it can be shown that the location of the mapped boundary does not adequately reflect the intended boundary criteria. Revisions of the adopted maps shall be based on precise boundary determinations made using the criteria set forth in Section 13677 of Article 17 of the California Administrative Code , Local Coastal Program Implementation Regulations and Section 19.07.040 of this title. The revised map shall be filed with the affected jurisdiction within thirty days of adoption by the California Coastal Commission.

§ 19.07.030. Boundary interpretations.

If questions arise concerning the precise location of the boundary of any area defined in Section 19.07.040 of this chapter, the matter should be referred to the Community Development Department of the City of Imperial Beach and/or the Executive Director of the Coastal Commission for clarification and information.

§ 19.07.040. Criteria for permit and appeal jurisdiction boundary determinations.

For purposes of Public Resources Code Sections 30519, 30600.5, 30601, 30603, and all other applicable provisions of the Coastal Act of 1976, the precise boundaries of the jurisdictional areas described on the Post Certification LCP Map shall be determined using the criteria set forth in Section 13577 of Article 17, California Administrative Code, Local Coastal Program Regulations as the same now exists or may hereafter be amended.
