The City Council, the City Attorney, the City Manager, the Police Chief, the Development Services Director, the Director of Community Services, the City Clerk, and all officials or their designees charged with the issuance of licenses or permits shall enforce the provisions of this title. Any permit, certificate, or license issued in conflict with the provisions of this title shall be void. (Ord. 827 § 2 (Exh. 1), 2019; Ord. 518, 1999; Ord. 113 § 1 (Exh. A 1.6(A)), 1983)

All erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings and structures within the City of Poway shall be in conformance with the Poway Municipal Code as determined by the Development Services Director or their designee. Any building or structure erected hereafter, or any use of property contrary to the provisions of a duly approved development permit, minor development review, variance, conditional use permit, or administrative permit, and/or this title, is unlawful and a public nuisance per se and subject to abatement, citations and penalties in accordance with Chapters 1.08, 1.10, 8.72 and 15.32 PMC. All remedies concerning this title shall be cumulative and not exclusive. The conviction and punishment of any person or responsible person, as defined in Chapters 1.08 and 1.10 PMC, shall not relieve such persons from the responsibility of correcting prohibited conditions or removing prohibited buildings, structures, signs, or improvements, and shall not prevent the enforced correction or removal thereof. Any responsible person, partnership, organization, firm or corporation, whether as principal, agent, employee or otherwise, violating any provisions of this title or violating or failing to comply with any order or regulation made under this title, shall be guilty of a misdemeanor and/or assessed other penalties and, upon conviction or determination thereof, shall be punishable as provided by Chapters 1.08, 1.10, 8.72 and 15.32 PMC.
