Chapter 38 — PERSONNEL POLICIES

§ 38.01 CIVIL SERVICE SYSTEM; CIVIL SERVICE COMMISSION. ¶
A Civil Service System is hereby created for the city and the appointment of a board of five Commissioners authorized, to be known and designated as the Civil Service Commission.

§ 38.02 COMMISSION; MEMBERS, TERMS, OFFICERS AND PROCEEDINGS. ¶
(A) Members. The members of the Civil Service Commission shall be appointed by the City Council. The members shall be residents of the city during their respective terms. In the event that a member ceases to be a resident of the city, his or her term shall terminate 30 days from the date residency is terminated, or at the conclusion of his or her term, whichever is sooner.
(B) Terms of office. The members of the Civil Service Commission shall hold office for a period of two years and may be appointed for additional two-year terms. Following expiration of his or her term of office, a member shall continue to serve until a successor is appointed and takes office; however, if no successor is appointed and takes office within 30 days, the extended period shall terminate and the office shall be deemed vacant.
(C) Compensation. The members of the Civil Service Commission shall serve without compensation.
(D) Officers. The members of the Civil Service Commission shall organize by electing one of their number the Chairperson who shall act as presiding officer. They shall also appoint a suitable person of their membership or a person from the city staff as Secretary of the Commission, who shall act and hold office at the pleasure of the Commission. (E) Records, rules, and regulations. The Civil Service Commission shall keep a record of its proceedings and shall provide rules and regulations for the keeping of service records and for the classification of employees.

§ 38.03 CIVIL SERVICE RULES AND REGULATIONS. ¶
The City Council may, by resolution, adopt and from time to time amend, such civil service rules and regulations as may be necessary for the complete and efficient operation of the Civil Service System.

GRAND JURY APPEARANCES
§ 38.15 DUTY TO APPEAR. ¶
It shall be the duty of any employee of the city, whether in the classified civil service status or otherwise, who may be subpoenaed by a legally constituted grand jury in and for the county, to appear before the grand jury and specifically to answer under oath any questions propounded by any member of the counsel of the grand jury relating to: (A) The crime of bribery or attempted bribery of any officer or employee of the city; or
(B) Wilful or corrupt misconduct in office of any public officer or employee of the city.

§ 38.16 FAILURE TO TESTIFY. ¶
Any employee of the city who fails or refuses to answer under oath, on any ground whatsoever, any such question propounded by any member or counsel of the grand jury with respect to any matter set forth in § 38.15 of this chapter shall be guilty of insubordination and of violating the provisions of this subchapter. At the discretion of the Council, any such employee may be suspended and/or dismissed from his employment in the manner provided by law, notwithstanding any policy established by the Civil Service Commission to the contrary or the provisions of §§ 38.01 through 38.03 creating a Civil Service Commission and providing regulations therefor to the contrary.
