§ 97.01 ADOPTION OF LOS ANGELES COUNTY PUBLIC HEALTH AND SAFETY CODE.

Subject to the additions, deletions and amendments hereinafter set forth in this subchapter, the rules, regulations, provisions and conditions set forth in that certain code entitled Los Angeles County "Health and Safety Code," Title 11 Los Angeles County Code including amendments thereto through County Ordinances No. 95-0056, including the following: Division 1 - Health Code; Division 2 - General Hazards; Division 3 - Miscellaneous Regulations; Division 4 - Underground Storage of Hazardous Materials; Appendices to Title 11 and such code shall be and become the Health and Safety Code for the city. One copy of the County Health and Safety Code has been deposited in the office of the City Clerk and shall be at all times maintained by the Clerk for use and examination by the public. Said edition of the County Health and Safety Code, except as provided in this subchapter, is substituted for and shall take the place of the previous edition of the County Public Health Code previously adopted. RATS AND VERMIN

§ 97.10 DEFINITION.

For the purpose of this subchapter, RATPROOFING shall mean a continuous masonry foundation of the size and depth required by the building code and other requirements for a new building of the same occupancy with regard to clearances beneath wood joists, wall coverings adjacent to the top foundation and the protection of roof and foundation openings, or any openings or holes in stud walls.

§ 97.11 RATPROOFING FOR GRAIN STORAGE REQUIRED.

No person shall use any building or structure, or portion thereof, for the storage, handling, preparation or sale of any grain or grain products which, in the opinion of the Health Officer, are, or are likely to become, infested with rats unless such building or structure, or portion thereof, has been ratproofed. § 97.12 RATPROOFING STRUCTURES HOUSING FOOD FOR HUMAN CONSUMPTION REQUIRED.

No person shall use any building or structure, or portion thereof, for a slaughterhouse, packinghouse or bakery or for the manufacture, preparation, storage, handling or display of any food or food product for human or animal consumption which, in the opinion of the Health Officer, is, or is likely to become, infested with rats unless such building or structure, or portion thereof, has been ratproofed.

§ 97.13 MAINTAINING RAT HARBORAGES UNLAWFUL.

It shall be unlawful for any person to maintain any building, lot, premises, vehicle or any place in such an unsanitary condition as to permit the breeding or harboring therein or thereon of flies, rats, bedbugs, cockroaches, lice or any vermin. It shall be unlawful for any person to permit an accumulation of rubbish material that may serve as a harborage for rats unless such material is elevated not less than 18 inches above the ground with a clear intervening space thereunder.

§ 97.14 NOTICE TO RATPROOF; SERVICE.

(A) When determined by the Health Officer, or his duly authorized representative, that any building or structure mentioned in this subchapter constitutes a rat harborage, he may serve upon the person in charge or control thereof a notice in writing to ratproof such building or structure, as set forth in § 97.15, within a reasonable time as stated in such notice. (B) When determined by the Health Officer, or his duly authorized representative, that it is unnecessary to ratproof such building or structure in its entirety, he may specify in such notice that portion which shall be ratproofed.

§ 97.15 RATPROOFING SPECIFICATIONS.

In addition to the other requirements set forth in this subchapter, any building or structure, or portion thereof, used for the storage or handling of any grain or grain product or any food or food product for human or animal consumption, except dwellings or apartments, shall be ratproofed as follows:

(A) Ratproofing. Buildings shall be ratproofed in such a manner as may be prescribed in the Los Angeles County Health and Safety Code and/or the Uniform Building Code, as adopted by the city.

(B) Screening. All underfloor vents, openings in foundations, roof vents and skylights shall be screened by the use of screening of at least one-half inch mesh hardware cloth. (C) Foundations.

(1) All foundations, except as otherwise provided in this subchapter, shall be continuous masonry foundations as specified for Type V buildings in the Uniform Building Code.

(2) Buildings erected without a continuous foundation and upon a slab of cement or asphaltic concrete not less than three inches in thickness need not be ratproofed as required if a concrete curb not less than one foot in depth below the natural ground grade is run continuously around and under the outside edges of such slab.

(3) Buildings under 400 square feet in area, having an 18-inch clearance under the floor joists and supported on piers, need not have the required continuous foundation. (D) Walls. A 12-inch strip of non-corrodible metal lath, weighing not less than three-fourths pounds per square yard, shall be placed under wall coverings on the inside and outside of all exterior stud walls at the floor level; provided, however, such strip need not be placed on the outside face when there is maintained a clearance of 18 inches under the floor joists, or when the exterior wall covering is stucco. § 97.16 INTERFERENCE WITH HEALTH OFFICER.

No person shall refuse, resist or attempt to resist the entrance of the Health Officer into any railway car, vehicle, building, room, lot or other place, or portion of room thereof, in the city in the performance of his duties, nor refuse to obey any lawful order of the Health Officer made in the performance of his duties within the powers conferred upon him by law or by the provisions of this subchapter.

§ 97.17 FOOD ESTABLISHMENTS.

Ordinance No. 2010-00451 of the County of Los Angeles is hereby adopted and made a part of the San Gabriel Municipal Code. A copy of said Ordinance shall be maintained on file by the City Clerk.
