PATROL SERVICES AND IN-HOUSE SECURITY PROGRAMS*

• A. A "private patrol operator," or "operator of a private patrol service," means a person who, for any consideration whatsoever agrees to furnish or furnishes a watchman, guard, patrolman or other person to protect persons or property or to prevent the theft, unlawful tak-

ing, loss, embezzlement, misappropriation or concealment of any goods, wares, merchandise, money, bonds, stocks, notes, documents, papers or property of any kind; or performs the service of such watchman, guard, patrolman or other person, for any of said purposes.

• B. An "in-house security program" means a program established by a corporation, company, or other business entity, or by a private individual, for the purpose of protecting persons or property or to prevent the theft, unlawful taking, loss, embezzlement, misappropriation or concealment of any goods, wares, merchandise, money, bonds, stocks, notes, documents, papers, or property of any kind, which said program involves the hiring of employees to perform the services of watchman, guard, patrolman, or security officers on the premises of said corporation, company, or other business entity, or of said private individual.

• A. It shall be unlawful for any person or any employee of a private patrol operator to engage in private patrol activities within the city without having in his possession evidence of current registration with the state pursuant to subdivision (f) of Section 7514 of the California Business and Professions Code.

• B. It shall be unlawful for any person or any employee of an in-house security program who is armed with a deadly weapon to engage in in-house security activities within the city without having in his possession evidence of current registration with the state pursuant to subdivision (f) of Section 7514 of the California Business and Professions Code.

Any person or employee of a private patrol operator or in-house security program who is re-

quired to register with the state pursuant to subdivision (f) of Section 7514 of the California Business and Professions Code shall present evidence of current registration with the state to any peace officer upon demand.

The chief of police may prescribe reasonable rules and regulations concerning the uniforms and insignias worn by uniformed employees of a private patrol operator or an in-house security program, and vehicles used by a private patrol operator or an in-house security program, to make the uniforms and vehicles clearly distinguishable from the uniforms worn by, and the vehicles used by, local regular law enforcement officers.

It shall be unlawful for any person who is engaged in private patrol activities or in in-house security activities within the City of San José to wear a uniform or insignia or to use a vehicle except in compliance with those rules and regulations promulgated by the chief of police, a copy of which shall be filed for use and examination by the public in the office of the city clerk.
