Chapter 6.70

For purposes of this Code:

• A. "Tobacco vending machine" means any mechanical device or automatic vending machine in an operating condition, containing cigars, cigarettes, or tobacco in any form.

• B. "Vending machine" or "automatic vending machine" means any vending apparatus which by mechanical means produces for, and gives to, the person who places coin or money or other representative of value therein the same return in personal property each and every time such machine is operated, by placing coin or money, or the representative of either, therein.

No person, either as owner, lessee or otherwise, shall maintain on any premises under such person's control any vending machine including, but not limited to, tobacco vending machines as defined in Section 9.45.010 of Title 9 of this Code, except in accordance with the provisions of this Code.

No person shall operate or keep in his or her possession, or in the possession of any other person within the limits of the city, any vending machine which does not give the same identical return on each identical operation thereof.

within the city, any vending machine that does not indicate at all times, by plainly legible notice thereon, exactly what return will be received by the person placing a coin or coins or paper money or other thing of value therein.

• D. "Reading material" shall mean any book, magazine, pamphlet, video cassette or newspaper offered for sale in a commercial establishment.
