Chapter 18.124 — PROCEDURES FOR PRECISE ZONING AND AMENDMENTS

§ 18.124.010. Generally.

In order to implement the policies delineated in the general plan and to ensure compatibility of this title with the general plan, this title may be amended to change district boundaries or to change any other provisions thereof whenever the public necessity and convenience and the general welfare require such amendment by following the procedure of this chapter. § 18.124.020. Initiation.

An amendment may be initiated by:

  • (1) The property owner of record whose petition shall be filed with the planning commission and shall be accompanied by a fee set by the board of supervisors, no part of which shall be returnable to the petitioner; or by

(2) Action by the board of supervisors. (Ord. 467 § 44, 1984)

§ 18.124.030. Public hearing.

  • (a) The planning commission shall hold one public hearing on any proposed amendment, and shall give notice thereof by at least one publication in a newspaper of general circulation within the county at least ten days prior to such hearing.

  • (b) The planning commission shall give additional notice of the time and place of such hearing and of the purpose thereof by posting public notices thereof not less than ten days prior to the date of such hearing along the streets or roads upon which the property proposed to be reclassified abuts and in the vicinity thereof. Any failure to post public notices as aforesaid shall not invalidate any proceedings for amendment of this title.

§ 18.124.040. Action by planning commission.

Following the hearing mentioned in Section 18.124.030 the planning commission shall submit a report of its findings and a summary of such hearing, together with its recommendations with respect to the proposed amendment to the board of supervisors. (Ord. 467 § 44, 1984)

§ 18.124.050. Action by board of supervisors.

  • (a) Upon receipt of such report from the planning commission, the board of supervisors shall set the matter for public hearing and shall give notice thereof by one publication in a newspaper of general circulation within the county at least ten days prior to such hearing. Within ninety days from the date of receipt of the planning commission's report, the board of supervisors may adopt the proposed amendment or any part thereof.

  • (b) Upon the consent of the planning commission, any petition for an amendment may be withdrawn upon the written application of a majority of all the persons who sign such petition. The board of supervisors may by resolution abandon any proceedings for an amendment initiated by its own action; provided, that such abandonment may be made only when such proceedings are before such body; provided, that any hearing of which public notice has been given shall be held.
