  • A. The “lesser of” test is required at both initial and subsequent renewal. (See section 524(b)(1) of MAHRA and 24 CFR Part 402.5(b).) The rents are to be set at the lesser of:

    1. Current rents as adjusted by OCAF; or

    2. Budget-based rent level.

Note: Project rents may be reduced.
