19.5.9.9 Lender’s Current Payment Letter and Certification

A. Lender must submit a letter dated the day of Final Endorsement confirming the following:

  1. The loan is current;

  2. No event has occurred that, with the giving of notice or passing of time, will constitute an Event of Default under the HUD Loan Documents; and

  3. Any required confirmations from the Lender’s Certificate (form HUD-92434M) that Lender could not make at Initial Closing.
