A. Any property available for first occupancy after March 13, 1991 that does not comply with the Fair Housing Act design and construction requirements must, as a condition of insurance, be modified/retrofitted to comply with Fair Housing Act accessibility guidelines. Similar but distinct requirements exist for any property now or ever federally assisted (per Section 504 of the National Rehabilitation Act of 1973). The Americans with Disabilities Act may also apply to portions of a property. HUD may approve the modifications/retrofits to be completed after endorsement with appropriate financial escrows at closing, and the work must be performed in accordance with instructions in Section 5B “Accessibility for Persons with Disabilities.”
