A.5.2.4.3 When Both Section 504 and the Fair Housing Act Apply

A. With respect to physical accessibility requirements, both Section 504 (applies to programs or activities that receive Federal financial assistance) and the Fair Housing Act (applies to covered multifamily dwellings designed and constructed for first occupancy after March 13, 1991) may apply. Recipients subject to both laws must be aware of, and comply with, the requirements of both laws and their implementing regulations. (See Notice H 01-02).
